In order to achieve this, we must collect, review, analyze, and utilize certain client sales data, which is an essential part of our operations. This data is contained within the client's Amazon account and may include, but is not limited to, product names, number of units sold, sale prices, revenue received, and Amazon fees paid (referred to as "Data"). We take great care to protect this data and use it in compliance with our Client Sales Data Privacy Policy.

However, we will never disclose any client-specific identifying information, including Confidential Information as defined in our Service Agreement.

Disclosure of Your Information to Third Parties

  • To our subsidiaries and affiliates, as necessary;
  • To contractors, service providers, and other third parties we use to support our business;

Please note that the Data we collect is from Amazon, and we assume no responsibility for, and are in no way liable for, any disclosure of the Data resulting from Amazon’s practices, actions, inactions, or omissions. We understand the importance of protecting your data and maintaining its confidentiality, and we take all necessary measures to ensure its safety and security.

Cogent Solutions recognizes the importance of protecting your Data and has implemented certain measures to ensure its safety and security. These measures include third-party encryption software, individualized login credentials for Company employees and contractors, and access logs. We use commercially reasonable efforts to protect the Data from unauthorized access, use, alteration, and disclosure.

However, the safety and security of the Data also depend on your actions. It is important that you monitor your Amazon account, internal controls, and Data to ensure it is protected at all times. We strongly advise you to not provide your Amazon account credentials to unauthorized individuals and to maintain the confidentiality of your login information.

Please note that while we take measures to protect the Data, the storage of information on the internet is not without risk. No method of information storage on the internet is completely secure, and we cannot guarantee that the Data cannot be accessed by unauthorized individuals. We are not responsible for the circumvention of any security measures we implement.

Use of Data Following Termination

Upon termination of the Service Agreement between the Company and you, we will retain your data as long as necessary to fulfill the purposes outlined in the Service Agreement and this Policy or to comply with any applicable legal obligations.

We reserve the right to analyze your data and use the insights gained from it for market research, internal analysis, and marketing to strengthen our services, enhance their functionality, or expand our offerings to other clients. However, we will not disclose any identifying client-specific information, including Confidential Information (as defined in the Service Agreement), in any such disclosures to third parties.

Disclaimers, Limitations on Liability, and Indemnification

Cogent Solution understands the importance of the confidentiality, security, and accuracy of the Data (as defined in this Policy) it handles, and it takes all necessary steps to protect it. However, Cogent Solution does not warrant the accuracy, completeness, or reliability of the Data, and any reliance placed on it is solely at the user's own risk.

To the fullest extent permitted by law, Cogent Solution disclaims all warranties, whether express or implied, statutory, or otherwise, including but not limited to any warranties of merchantability, non-infringement, and fitness for a particular purpose.

Cogent Solution, its officers, agents, employees, or directors will not be liable for any damages, under any legal theory, arising out of or in connection with the use, access, or dissemination of the Data, including but not limited to emotional distress, loss of revenue, loss of profits, loss of business or anticipated business, loss of use, and loss of goodwill.

This limitation of liability does not apply to liability resulting from Cogent Solution’s gross negligence or willful misconduct.

Users agree to defend, indemnify, and hold harmless Cogent Solution, its affiliates, officers, directors, agents, employees, contractors, successors, and assigns from and against any and all Claims, arising out of or relating to the use of the Data in connection with the Services, and as set forth in this Policy. This includes but is not limited to any Claims brought by or on behalf of Amazon, its affiliates, subsidiaries, related entities, successors, or assigns.

Cogent Solutions may amend this Data Privacy Policy from time to time in our sole discretion. We encourage you to review this Policy periodically to remain informed of any updates. Material changes to this Policy will be communicated to you in writing.
